These general terms and conditions of sale (hereinafter referred to as the "T&Cs") apply to all transactions involving the sale of large-format printing equipment, ink, and new and used spare parts (hereinafter referred to as the "Products"), carried out by GEL INK (hereinafter referred to as the "Company") with professional customers (non-consumers) (hereinafter referred to as the "Customer").
By choosing to purchase a Product from GEL INK, the Customer expressly and unreservedly agrees to these T&Cs and confirms that they are acting as a professional, placing the order in the course of their business activity.
It should be noted that the provisions of the French Consumer Code do not apply to purchases made by the Customer (except for professionals meeting the criteria of Article L. 121-16-1), which are governed exclusively by these T&Cs as well as by the mandatory provisions of the French Commercial Code and French Civil Code relating to sales.
Validating an order on our website implies formal and unconditional acceptance of the T&Cs as well as our Personal Data Protection Policy, which the Customer acknowledges having read and accepted by ticking the box provided for this purpose when creating an account and/or when confirming the order.
These T&Cs fully replace all previous versions of the general terms and conditions of sale, thereby rendering earlier versions null and void.
2. Product Information
The Products are described on our website in such a way as to provide the buyer with all essential information, including the main features and prices.
GEL INK takes all necessary steps to ensure the accuracy and reliability of the information presented on its Website. Despite daily monitoring and updates, GEL INK declines any liability in the event of technical inaccuracies, typographical errors, or omissions in the Website content, or for any results that may arise from the use of such information.
The Customer acknowledges that the photographs, information, and visuals of the Products presented on the Website are not contractual. Consequently, GEL INK cannot be held liable for any incident related to the image of the relevant Product.
The brands mentioned on the website are the property of their respective owners. Product specifications may be subject to change due to technological developments or our suppliers’ offerings.
3. Order and Validation
The Products offered for sale on the Website are intended exclusively for persons with full legal capacity to make online purchases.
3.1 Creating a customer account
Before placing any order, the Customer must create an account on the Website. The “Register / Log in” section is easily accessible from the main page.
The information required to create an account includes: a valid email address, a password, last name, first name, company name, phone number, billing address, and VAT number.
On each subsequent visit, if the Customer wishes to place an order or access the “Register / Log in” area, they must first identify themselves using the strictly personal and confidential information they have chosen.
The Customer is responsible for keeping their credentials confidential. In the event of loss, forgetting, or misuse of credentials by a third party, the Customer must immediately inform GEL INK by contacting Customer Service.
GEL INK informs the Customer that the creation of their personal account on one of GEL INK’s websites is valid for all GEL INK websites. Thus, their usernames and passwords remain unchanged for any login on these websites. If the Customer requests deletion of their personal data linked to their customer account, such deletion will be automatically carried out on all GEL INK websites.
Providing the personal information collected as part of distance selling is mandatory, as this data is necessary for processing orders, shipping them, and issuing invoices. Any failure to provide such information will result in the order being invalidated.
3.2 Purchase
To make a purchase, the Customer must place their order directly on the Website.
The purchase process begins with the Customer selecting the Product(s) that meet their needs and then adding them to the cart.
To ensure effective delivery of the Product, the Customer must provide all required information such as their last name, first name, delivery address and, where applicable, a different billing address, as well as a phone number.
If the Customer already has an account on the Website and wishes to validate their order, they will be automatically redirected to a login page where they must sign in using their personal information. If they are a new Customer, they must follow the account creation steps via the “Register / Log in” section.
Once the Customer validates their cart, an order summary is displayed showing: Product(s), quantity(ies), unit price, any discounts, delivery method and shipping fees, as well as the total amount of the order.
The Customer may review, supplement, modify, or cancel the order as long as it has not yet been validated. Once the Customer clicks the “Order with obligation to pay” button, the order is deemed confirmed.
Order confirmation is subject to the Customer having read and expressly accepted, without reservation, via a tick box, these T&Cs and the Personal Data Protection Policy, and entails an obligation to pay.
Once these steps have been completed—validation of the cart, selection of delivery and payment method—GEL INK will send the Customer an order confirmation email within twenty-four (24) hours of the order being recorded. If the Customer does not receive this email within the indicated timeframe, GEL INK invites the Customer to contact Customer Service.
Please note that full payment for the order is collected by GEL INK at the time the order is confirmed, unless a prior agreement has been made between GEL INK and the Customer. This confirmation is notified to the Customer by email and via the “Payment accepted” status in the “My orders” section of the Customer’s “My account” area.
The sale will only be concluded upon confirmation of the order. GEL INK reserves the right to cancel any order from a customer involved in a dispute regarding payment for a previous order.
Orders placed by the Customer on the website are final and cannot be cancelled, unless GEL INK has given prior agreement. The Customer acknowledges that they are bound by the purchase as soon as they make the online payment, unless GEL INK expressly accepts an order cancellation.
In the event of any incident relating to the Customer’s order, such as a payment issue, supply issue, unavailability of Products, or any other anomaly, GEL INK undertakes to inform the Customer using the contact details provided in the Customer’s account (as last updated).
4. Prices and Payment Terms
All prices are indicated in euros, excluding taxes, and do not include other costs such as transport and handling fees, which remain payable by the Customer.
The Customer must provide a valid and correct VAT number and holds the Company harmless from any liability, costs, issues, or proceedings resulting from the provision of an incorrect or inappropriate VAT number.
Prices are determined based on economic conditions, taxes or duties applicable at the time of the order, as well as the rates of the Company’s suppliers and subcontractors.
GEL INK reserves the right to change its prices at any time, but Products will be invoiced on the basis of the rates in force at the time the order is recorded, subject to availability.
The Company may withhold shipment of goods until the order has been paid in full.
GEL INK offers the Customer three secure payment methods:
- By bank card: immediate or deferred payment (CB, VISA, MASTERCARD, MAESTRO);
- By PayPal;
- By bank transfer.
Bank charges related to an order are not included in the price and are payable by the Customer.
For shipments outside mainland France, the taxes, duties and shipping costs mentioned in the product description may be subject to other import taxes and duties upon arrival of the parcel at its destination. The Customer is responsible for paying all import taxes and duties. Before placing an order, it is recommended to contact local customs authorities to obtain information and estimate the actual costs at destination. GEL INK shall not be legally liable if such taxes are not paid by the Customer.
5. Delivery
Some Products or shipping methods may benefit from reduced or free delivery charges (free shipping).
5.1 Delivery terms:
In the event of a shipping delay exceeding 48 hours for the ordered Products, the Customer may cancel the order or accept a new timeframe, without being entitled to any price reduction or damages.
For availability reasons, an order may be delivered to the Customer in several shipments at no additional cost. If the Customer requests delivery to two different addresses, they must place two separate orders, with the corresponding delivery charges.
Delivery time after shipment depends on the carrier selected. Deliveries in France are carried out by La Poste, DPD, or Chronopost. For deliveries outside France, carriers may include La Poste, Chronopost, UPS, DHL, FedEx, TNT, or GLS. GEL INK chooses the carrier offering the best price/time ratio. If you require a specific carrier, please contact us.
Deliveries are made subject to goods availability. Unless otherwise stated in writing, delivery dates provided by the Company are indicative only. Any delivery delay may not be invoked as grounds for cancelling the purchase, refusing the goods, or claiming compensation. Any delay in a staged delivery does not affect other deliveries.
If the Customer does not collect the goods after formal notice, the Company reserves the right, without prejudice to any claim for damages, to enforce the contract or to consider it automatically terminated, while retaining any transport costs incurred (outbound delivery and return to sender).
5.2 Delivery anomalies:
GEL INK monitors delivery times for parcels entrusted to carriers. However, if the Customer notices a delivery anomaly (delay, change of pick-up point, loss of tracking, etc.), the Customer is invited to contact the Company so that a solution can be found as quickly as possible.
5.3 Customer absence:
The Customer must provide all information necessary for successful delivery: last name, first name, delivery or pick-up address, and billing address if different, as well as a phone number.
If the Customer is absent at the time of delivery, the carrier will leave a delivery notice. The Customer may arrange to collect the Products within the timeframe indicated by the carrier. After this period, the Products will be automatically returned to GEL INK.
In the event of difficulties, the Customer must inform GEL INK within the required time limits.
5.4 Delays:
GEL INK strives to meet Product delivery times according to the delivery method chosen by the Customer. Delivery times will not exceed thirty (30) days from validation of the order, except in cases of force majeure. In the event of a significant delay, the Customer is invited to contact the Company to find a quick solution.
5.5 Parcel inspection – Damage:
Depending on the selected carrier, parcels may be delivered to a pick-up point against signature, delivered to the Customer’s address in person (with or without signature), or directly into the Customer’s mailbox.
Regardless of the delivery method, the Customer must check the condition of the packaging and the contents of the parcel upon delivery. In case of an issue, the Customer must make written reservations to the carrier and keep a copy. Any refusal of a parcel must be made within three (3) business days from receipt of the Products.
If the Customer fails to report any problem within the required time limit, the Customer will be deemed to have accepted the Products without incident, damage, or anomaly. As a result, no claim for defects such as damage, missing products, damaged parcels, or broken parts upon receipt will be accepted by GEL INK.
However, the Customer always retains the benefit of the legal warranties of conformity and hidden defects.
5.6 Export/import compliance:
The Customer undertakes to comply with all export/import control laws. The Customer undertakes not to export/import goods from/to a country in violation of an export/import control law without having first obtained all required licenses or authorizations.
6. Right of Withdrawal and Product Returns
As stated above, by choosing to purchase a Product from GEL INK, the Customer confirms that they are acting as a professional, placing the order in the course of their business activity.
In accordance with Article L. 121-16-1 of the French Consumer Code, the right of withdrawal only applies to eligible professionals who fall within the legal scope specified. The relevant Customers may exercise their right of withdrawal within fourteen (14) days from receipt of the Products, subject to the conditions and procedures provided by law.
To exercise the right of withdrawal, the Customer must notify GEL INK in writing of their decision to withdraw before the expiry of the aforementioned withdrawal period. Any return of a Product under the right of withdrawal must be made in accordance with the instructions provided by GEL INK and the specific conditions set out in these T&Cs.
For Customers who do not fall within the legal scope of the French Consumer Code, return authorization will be assessed by GEL INK on a case-by-case basis. The Customer is invited to consult the applicable legal provisions and to contact GEL INK with any questions regarding eligibility for the right of withdrawal and how to exercise it.
6.1 Return procedure:
The Product(s) must be returned in their original and complete condition (including packaging, accessories, instructions, etc.), packaged in the same way as when shipped, within 14 (fourteen) days from the date of withdrawal or return authorization. It is the Customer’s responsibility to provide proof that the product(s) were returned on time.
Upon receipt of the product(s), we will examine them to verify that they are in the same condition as when the Customer received them. No refund will be issued if the product(s) have been used or damaged.
6.2 Customer refund when exercising the right of withdrawal:
Subject to the Customer’s compliance with the above terms, GEL INK undertakes to refund the Customer the price of the purchased Product(s) as well as the shipping costs, no later than fourteen (14) days following receipt of the Customer’s withdrawal request. However, GEL INK is not required to refund additional costs if the Customer expressly chose a delivery method other than the least expensive standard delivery method offered by GEL INK on the Website. Return shipping costs are payable by the Customer.
GEL INK reserves the right to defer the refund until the returned Products have been recovered.
The refund will be made using the same payment method used by the Customer for the initial order, unless technically impossible or otherwise agreed between the Customer and GEL INK.
6.3 Customer refund outside the exercise of the right of withdrawal:
In cases other than exercising the right of withdrawal, GEL INK reserves the right to determine the refund terms, which may include an exchange of the Product, a refund in the form of a credit note, or a refund to the payment method used for the initial order. In these situations, initial shipping costs will not be refunded. The choice between these options will be made by GEL INK depending on the specific circumstances of each case.
7. Warranty and Liability
7.1 Warranty:
GEL INK disclaims any warranty and liability in the following cases:
- Consumables and wear parts;
- Transport damage not reported within 24 hours of receipt of the parts;
- Damage or aesthetic defects resulting from the use of the parts;
- A defect or incompatibility of another part of the equipment linked to the part sold;
- Use of the part outside the purpose intended by the manufacturer;
- Any unauthorized or unplanned modification or adaptation of the part or any other equipment part;
- Abnormal use or failure to follow maintenance recommendations for the equipment, or accidental damage.
Any peripheral parts included with the main equipment are provided free of charge and are not covered by the contractual warranty.
Products sold by GEL INK must be used in accordance with their specifications by competent persons and under the Customer’s sole responsibility. GEL INK disclaims any liability for the consequences of incorrect or inappropriate use of the Products sold.
Products suspected of being defective must be returned to the Company with its prior consent. They will then be examined to demonstrate their non-conformity with manufacturing or material standards, ensuring that such non-conformity is in no way due to an accident, mishandling, negligence, modification, inappropriate use, repair, or inadequate testing by the Customer.
With regard to hidden defects:
The seller guarantees the absence of hidden defects in its goods. A hidden defect is characterized by significant faults that the Customer could not have detected at the time of delivery, resulting from defective equipment or poor manufacturing. Only defects that substantially reduce the usefulness of the goods for their normal use will be covered by this warranty.
This warranty is limited to hidden defects that are notified to the Company in detail, by email or any other reliable means (in writing), within fourteen (14) days of their discovery and, at the latest, within one (1) month from the delivery date.
In all cases, the Company’s liability under this warranty will be limited to replacing the defective goods. No goods may be returned without the Company’s prior written agreement.
7.2 Liability:
GEL INK strives to provide the Customer with high-quality service. However, the Customer acknowledges that GEL INK is bound only by an obligation of means (best efforts).
Customer’s liability:
- Selection and use of Products: The Customer is solely responsible for the choice, selection, storage, and use of the Products. It is the Customer’s responsibility to check Product compatibility with their equipment before placing an order.
- Compliance with technical requirements: Given the technical nature of certain Products, the Customer must strictly follow the manufacturer’s technical requirements and safety recommendations, particularly regarding storage, assembly, and use of the Products.
- Reference to the user manual: The Customer must refer to the user and/or assembly instructions if provided with the ordered Product.
Limits of GEL INK’s liability:
- Conditions of Internet access: GEL INK’s liability cannot be incurred in the event of a Website malfunction related to Internet access conditions and any limitations or restrictions thereof.
- Contractual value of photographs and illustrations: The photographs and illustrations accompanying the Products on the Website have no contractual value.
Exclusions of GEL INK’s liability:
- Installation or use of Products by the Customer: GEL INK shall not be liable for any damage resulting from the Customer’s installation or use of the Products.
- Errors or omissions by the Customer: GEL INK shall not be liable in the event of incorrect, incomplete, or improperly provided contact details by the Customer.
- Content of linked websites: GEL INK shall not be liable for the content of websites linked directly or indirectly to the Website that are not under its control.
Limitation of liability:
- Amount of damages: GEL INK’s liability in the event of non-performance or improper performance of its contractual or non-contractual obligations shall be limited to the amount of actual and proven damages and losses suffered by the Customer, and in any event the overall amount, for all causes combined, shall not exceed the amount of the invoice for the relevant purchase. This limit also applies to any consequences that could be claimed against GEL INK in the event of nullity or termination of the sale.
- Indirect damages: GEL INK shall not under any circumstances be liable for indirect damages suffered by the Customer or a third party.
Force majeure: GEL INK cannot be held liable in the event of delay or failure to perform its obligations due to force majeure, such as natural disasters, governmental acts, or civil unrest. GEL INK reserves the right, in the event of force majeure, to suspend or terminate the sale in whole or in part. Force majeure is defined as any event capable of interrupting, reducing, delaying, or making the sale of the Products economically less viable, or hindering its normal performance. In such circumstances, the Customer shall not be entitled to any compensation from GEL INK.
8. Personal Data Protection
GEL INK is responsible for collecting and processing your personal data. We implement measures to ensure the confidentiality, security, and integrity of your data, and we require our service providers to comply with the same level of security as our own.
We expressly invite our customers to read our Personal Data Protection Policy.
Respect for individual freedoms is a fundamental value for GEL INK. We undertake never to transfer (sell, exchange, rent, give, lend) information concerning our Customers to third parties, except with their express consent.
We process personal data in accordance with the General Data Protection Regulation (GDPR). You have the right to access, rectify, and delete your personal data. If you do not accept our service offering, the personal data retained will be destroyed after one year. Your data will never be transmitted to any entity outside GEL INK, except in the event of a legal requisition. You may exercise this right by contacting us at info@gel-ink.com.
9. Compliance with Environmental Standards
GEL INK is firmly committed to complying with applicable laws and regulations regarding recycling and environmental protection. As a responsible player in the field of compatible ink refilling, large-format printer refurbishment, and the supply of used parts, we are fully aware of our responsibility to preserve our planet.
We actively strive to reduce our environmental footprint by promoting the recycling and reuse of equipment and spare parts. By extending product lifespans, we help limit waste production and preserve natural resources.
In addition, we are committed to working closely with our partners and suppliers to promote environmentally friendly practices throughout our supply chain. This includes selecting sustainable materials, reducing waste, and adopting eco-responsible technologies in our production and distribution processes.
At GEL INK, we consider environmental protection an absolute priority. We will continue to invest in initiatives and innovative solutions to minimize our impact on the planet and help build a more sustainable future for generations to come.
10. Product Availability
The Products offered are those shown on the Website, subject to available stock held by GEL INK and its suppliers.
The Customer acknowledges that Product availability, provided by GEL INK at the time the order is placed and upon receipt of the order validation email, is given for information purposes only. Despite regular stock updates, a discrepancy may occur between the stock shown on the Website at the time the Customer validates the order and the actual stock available when GEL INK records the order validation. GEL INK undertakes to confirm and/or inform the Customer of the availability of the ordered Product(s) within a maximum of 48 hours (excluding weekends).
In the event of a stock shortage, GEL INK will look for an equivalent Product meeting the same technical specifications, with similar quality and price, and may offer a replacement Product to the Customer.
If there is a price difference between the ordered Product and the delivered Product, it will be handled as follows:
- if the replacement Product has a higher value than the originally ordered Product, the price difference will not be charged to the Customer. GEL INK will bear the additional cost and invoice the Customer at the price of the ordered Product.
- if the replacement Product has a lower value than the originally ordered Product, the price difference will be adjusted in the Customer’s favor.
The Customer may refuse the replacement Product by following the return procedures set out in Article 6 of these T&Cs.
If no Product meeting the above criteria can be found by GEL INK, the Customer will be informed directly in their Customer “My account” area under “My orders” with the status “Cancelled”, and by email as soon as possible. GEL INK will then proceed with partial or full cancellation of the order.
GEL INK reserves the right to change its catalogue of Products available on the Website at any time.
11. Changes to the T&Cs
At GEL INK, we consider transparency and open communication essential to our relationship with our customers. We continuously strive to improve our practices to ensure that our customers are informed in an appropriate and fair manner of any significant changes affecting their rights and obligations. GEL INK reserves the right to amend these T&Cs at any time, in particular to develop its services or to comply with any new applicable regulations. The T&Cs applicable will be those in force on the date of the Customer’s order.
Notification of changes: Any changes made to our T&Cs will be communicated to customers in a clear and transparent manner. Customers will be informed via different channels, such as our website, email notifications, or any other appropriate means of communication.
Accessibility of the T&Cs: The T&Cs will always be available and easily accessible on our website. Customers may consult the T&Cs at any time and review the latest updates.
Assistance and clarification: Our team will be available to answer questions and provide clarification regarding changes made to the T&Cs. We are committed to providing full support to Customers to ensure they fully understand the terms and conditions.
12. Disputes and Applicable Law
These T&Cs are governed by French law. These T&Cs fully replace previous versions, which therefore no longer apply. These T&Cs constitute the entire agreement between GEL INK and the Customer. If any provision of these T&Cs is found to be invalid or unenforceable, it shall not affect the remaining provisions.
For any complaint, the Customer is invited to contact our Customer Service:
- either via the “Contact” page
- or by email at the following address: info@gel-ink.com
- or by phone at +33 4 37 41 58 48 (non-premium number, cost of a local call, Monday to Friday from 9:00 a.m. to 5:00 p.m., excluding public holidays), stating the order number.
Failing an amicable settlement, any dispute will be submitted to the French courts.
No tolerance or delay by GEL INK in exercising its rights shall prejudice or restrict GEL INK’s rights, and no waiver of these rights or waiver of a contractual breach shall be deemed to constitute a waiver of any other rights or of any subsequent contractual breach.
In the event of difficulties in applying this contract, the buyer has the option, before initiating any legal proceedings, to seek an amicable solution. This approach may notably be undertaken with the support of a professional association in the sector, a consumer association, or any other advisor of their choice.
It should be recalled that seeking an amicable solution does not affect the legal warranty period or the duration of the contractual warranty.
If no amicable resolution is reached, the Commercial Court of Draguignan (Tribunal de Commerce de Draguignan) shall have exclusive jurisdiction to settle any dispute, regardless of the delivery location or the payment method used.
13. Intellectual Property
The Customer acknowledges that all content present on the Website, including in particular the domain name, trademarks, texts, graphics, photographs, drawings, sounds, data, images, audio and video, as well as GEL INK’s structure, navigation plan, logos, the design and organization of its sections, their titles, databases, their structures and their content, whether already existing or added in the future, are protected and remain the exclusive property of GEL INK.
Consequently, unless expressly authorized in advance by GEL INK, any reproduction, representation, or use of these elements by the Customer is strictly prohibited. Any breach by the Customer of these obligations constitutes an infringement of GEL INK’s intellectual property rights.
If the Customer has a personal website and wishes to place a simple link directly to the Website for personal purposes, they must obtain prior written authorization from GEL INK. Such authorization may not be interpreted as implicit affiliate approval. In addition, any link must be removed upon simple request by GEL INK.
